By using or visiting our website www.frek.in, you agree to comply with and be bound by the following terms and conditions. If you do not agree with these terms, please do not access or use our website.

1. General

These Terms of Service (“Terms”) apply to all users of this website, including without limitation users who are browsers, vendors, customers, merchants, and/or contributors of content. Frek reserves the right to update, change, or replace any part of these Terms by posting updates or changes to the website.

Your continued use of or access to the website following the posting of any changes constitutes acceptance of those changes.

2. Eligibility

To use Frek.in, you must be:

  • At least 18 years of age, or

  • Accessing the site under the supervision of a legal guardian

You must also be legally capable of entering into binding contracts as per the laws of India.

3. Product Information

  • Frek deals in live plants, which are natural and perishable in nature. Variations in color, size, and appearance are natural and do not qualify as defects.

  • All images and descriptions are for reference purposes only.

  • While we strive to display the colors and features accurately, we cannot guarantee that your device’s display will match the exact appearance of the products.

4. Pricing & Payments

  • All prices displayed on Frek.in are in Indian Rupees (INR) and inclusive of applicable GST, unless stated otherwise.

  • Prices, discounts, and product availability may change without prior notice.

  • Payments must be made in full at the time of placing the order through our supported payment gateways (Razorpay, UPI, Cards, Net Banking, etc.).

  • In case of payment failures, the order will not be processed.

5. Order Acceptance & Cancellation

  • Placing an order on Frek.in does not confirm our acceptance of the order.

  • We reserve the right to cancel or refuse any order for any reason, including:

    • Inaccurate stock information

    • Payment issues

    • Fraudulent activity

    • Incomplete or invalid address

Once an order is placed and confirmed, it cannot be cancelled by the customer. As we deal in perishable items, we begin processing orders immediately after confirmation.

6. Shipping & Delivery

  • Orders are shipped using third-party courier partners, including but not limited to India Post (Speed Post), Delhivery, and others.

  • Estimated delivery times are provided during checkout, but we do not guarantee exact timelines.

  • Frek is not responsible for delays, misrouting, or damage caused during transit by courier partners.

  • Delivery is considered successful if tracking shows as “Delivered,” even if customer fails to receive the item.

If you select regular parcel post (untracked), we will not be able to provide refunds or replacements, as this method is not recommended for live plants.

7. Refunds, Replacements & Claims

We offer refunds or replacements only in the following situations:

✅ Accepted Cases:

  • Items that arrive completely damaged, rotten, or unusable

  • Missing items from your order

  • Wrong items delivered

❌ Not Accepted:

  • Orders with minor cosmetic transit damage (slightly bent stems, dry leaves)

  • Orders marked delivered but claimed undelivered without video proof

  • Customer changes mind after dispatch

  • Orders placed with wrong address or unclaimed by recipient

Conditions:

  • You must inform us within 24 hours of delivery

  • You must share a full unboxing video from start to finish without cuts

  • We will verify the evidence and process the resolution accordingly

8. Intellectual Property

All content on Frek.in including product names, logos, photographs, videos, text, and design elements are the intellectual property of Frek Enterprises and protected by copyright and trademark laws.

You may not reproduce, copy, sell, modify, or exploit any content for commercial purposes without written permission from Frek.

9. Prohibited Activities

You are prohibited from using this site or its content to:

  • Violate any laws or regulations

  • Harass, abuse, insult, or intimidate others

  • Upload viruses or malicious code

  • Impersonate Frek or its employees

  • Make false claims or fraudulent returns

Violations of these terms may lead to suspension or legal action.

10. Limitation of Liability

Frek and its team will not be held liable for:

  • Losses arising from courier delays or mishandling

  • Inaccurate customer details causing delivery failure

  • Damage caused by improper plant care after delivery

  • Indirect or consequential damages from using the website or products

Frek’s total liability will be limited to the amount paid for the affected product(s) only.

11. Third-Party Links

Our website may contain links to third-party websites or tools. Frek does not endorse, control, or assume responsibility for content or policies on those sites.

12. Governing Law

These Terms and any transactions conducted through Frek.in are governed by the laws of India. Any disputes shall be subject to the jurisdiction of the courts in [Your City/State, e.g., West Bengal, India].
