1. 🧾 Eligibility & Account

  • You must be at least 18 years old or have parental consent to use our Services.

  • You agree to provide accurate and complete information when placing orders.

  • You are responsible for maintaining the confidentiality of your account details and all activities under your account.

2. 🌿 Nature of Products (Important)

FREK sells live plants and natural products, which means:

  • Plants may vary in size, color, shape, and fullness

  • Minor imperfections are natural and expected

  • Product images are for reference only

We do not guarantee that the product will look exactly identical to images shown.

3. 🛒 Orders & Acceptance

  • Placing an order means you are making an offer to purchase

  • Orders are confirmed only after successful payment and acceptance by us

  • We reserve the right to accept, decline, or cancel any order at our discretion

❗ Cancellation Policy:

  • Orders can be cancelled within 2 hours of placing

  • After this, cancellation is not possible due to plant preparation (uprooting, air-drying, packing)

4. 💰 Pricing & Payments

  • All prices are listed in INR (₹) unless stated otherwise

  • Prices, discounts, and offers may change without notice

  • You agree to provide valid and up-to-date payment information

  • Applicable taxes and shipping charges will be added at checkout

5. 🚚 Shipping & Delivery

  • Delivery timelines are estimates only and not guaranteed

  • We are not liable for delays caused by courier services or events beyond our control

  • Risk of loss transfers to you once the order is handed over to the delivery partner

6. 🔄 Returns, Refunds & Replacements

All purchases are subject to our Refund & Replacement Policy.

🌱 Plants:

  • Replacement/refund only if completely dead or fully rotten

  • Must be reported within 24 hours with unboxing video and photos

🪴 Pots:

  • Eligible for replacement/refund if damaged during transit

  • Must be reported within 24–48 hours with proof

🌾 Soil:

  • No return or refund

7. 📸 Proof Requirement

For any claims:

  • Unboxing video (from sealed package opening) is mandatory

  • Clear photos must be provided

Claims without proper proof may not be accepted.

8. 🌵 Special Note (Succulents & Cacti)

  • Dry appearance does not mean the plant is dead

  • Root trimming or loss during shipping is normal

  • Refund/replacement only if the plant is fully rotten

9. 🧠 Intellectual Property

All content on this website—including images, text, logos, and designs—is owned by FREK.

You may not:

  • Copy, reproduce, or distribute content without permission

  • Use our brand name or materials for commercial purposes

Our website may contain links to third-party websites.
We are not responsible for their content, policies, or practices.

11. 💬 Feedback & Reviews

By submitting reviews or feedback, you grant FREK the right to:

  • Use, publish, and display it for business and marketing purposes

  • Correct errors in product details, pricing, or availability

  • Cancel orders if incorrect information is displayed

  • Continuous or error-free website access

FREK is not liable for:

  • Plant condition changes after delivery due to care conditions

  • Shipping delays or external disruptions

You agree to indemnify and hold FREK harmless from any claims arising from:

  • Your misuse of Services

  • Violation of these Terms

These Terms are governed by the laws of India, with jurisdiction in Darjeeling, West Bengal.
